Fabula (Full legal entity name: BİR YUDUM KİTAP YAYINCILIK A.Ş.) offers a subscription service that allows our members to access audio and readable text or book-like text content ("Fabula content") through the Internet with computers and other Internet-connected devices.
These Terms of Use establish the rules for using our service. Within the scope of these Terms of Use, the terms "Fabula service", "our service" or "service" are used by Fabula to find and read or listen to Fabula content; means the service, which includes all features and functions, recommendations and reviews, the website, user interfaces and all content and software related to our service.
Membership
1.1 Your Fabula membership continues until canceled. To use the Fabula service, you must have Internet access, a device that supports Fabula, and provide us with one or more payment methods. "Payment Method" means an existing, valid and recognized payment method, which you may update from time to time and which may include payment through a third party through your account. Unless you cancel your membership through third-party payment companies before the billing date, you authorize these companies to charge the membership fee for the next billing period through the Payment Method you have chosen (see "Membership Cancellation").
1.2. We may offer several different membership plans, including special promotional plans or memberships offered by third parties in conjunction with their products or services. Fabula is not responsible for products or services offered by such third parties. Some membership plans may have different terms and limitations that will be disclosed at the time you sign up for the service or in other communications made available to you.
Free Trials
2.1. You may start your Fabula membership with a free trial. The free trial period of your membership will be specified when you sign up, and the free trial period is designed for new members and certain former members to try the service.
2.2. Free trial criteria are determined at Fabula's sole discretion and we may restrict the right or duration of a free trial in order to prevent abuse. We reserve the right to cancel your free trial and freeze your account if it is determined that you do not meet the criteria. Restrictions may be imposed on use with other offers or discounts.
2.3. If you do not cancel your membership before the end of the free trial period, at the end of the free trial period, the payment company will charge the membership fee for the next billing period to the Payment Method you have chosen. To view the subscription fee and due date of your free trial period, you should visit the subscription management pages of the respective payment companies.
Billing and Membership Cancellation
3.1. Billing periods. The subscription fee for the Fabula service and all other costs, such as taxes and possible transaction fees that may arise due to your use of the service, will be charged to the Payment Method you have chosen. The length of your billing period depends on the type of subscription you choose when signing up for the service. In cases where your Payment Method cannot be approved or your paid membership begins on a day not included in the month in question, your payment date may change. Visit the subscription management pages of the respective payment companies to see your next payment date.
3.2. Payment methods. To use the Fabula service, you must offer one or more payment methods. You authorize us to charge any payment method associated with your account. In such case, you remain responsible for uncollectible amounts. If the payment method has expired, there are insufficient funds or for other reasons payment is not made correctly and you do not cancel your account, we may suspend your access to our service until we collect the subscription fee from a valid payment method. If you use some payment methods, the provider may charge you various costs related to processing your payment method, such as an external transaction fee. Local tax amounts may vary depending on the payment method used. Contact your payment method service provider for more details.
3.3. Membership cancellation. You may cancel your Fabula membership at any time and continue to benefit from the Fabula service until the end of your billing period. In accordance with distance contract regulations, payments made for the Fabula service are non-refundable, and there are no refunds or payments for subscription periods that have not been fulfilled by us, or for Fabula content that has not been read or listened to. To cancel your membership, go to the "Account" page and follow the instructions to cancel. If you cancel your subscription, your account will be automatically closed at the end of your current billing period. If you have used third parties as a payment method and want to cancel your Fabula membership, you may need to do so through that third party: for example, by accessing your account with that third party and disabling auto-renewal, or by canceling the subscription to the Fabula service through that third party. You can also find billing information for your Fabula membership by visiting your relevant third party account.
3.4. Changes to subscription plan and fees. We may change our subscription plan and the price of our service from time to time, but any price change or change to your subscription plans will be effective for billing periods after you are notified of such change.
Fabula Service
4.1. To subscribe to the Fabula service, you must be over 13 years of age or over 12 if you live in Brazil.
4.2. The Fabula service and any content accessed through the service are for your personal and non-commercial use only. We grant you a limited, non-exclusive and non-transferable right to access the Fabula service and access Fabula content during your Fabula subscription. Except as stated above, no rights, title or interest will be transferred to you.
4.3. The Fabula service, including content, is constantly updated. We also constantly test many aspects of our service, including our website, user interfaces, promotional content and the availability of Fabula content. At any time, you can visit the "Settings" page and submit your request not to be tested in the "Write your comments" section.
4.4. You agree to use the Fabula service, together with all features and functionalities associated with the service, in accordance with all applicable laws, rules and regulations or other restrictions on the use of the service or relevant content. You will not store, reproduce, distribute, modify, display, process, publish, license, create derivative works from, offer for sale or use (unless specifically permitted in the Terms of Use) any content or information stored or obtained from or through the Fabula service, you are deemed to have agreed. Also; you will not circumvent, remove, modify, disable, degrade or interrupt any of the content protections within the Fabula service; you will not use any robot, spider, scraper or other automated means to access the Fabula service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Fabula service; you will not embed or manipulate Fabula service content in any way; You agree not to use any data mining, collection or extraction methods. Additionally, you agree not to upload any computer software or hardware associated with the Fabula service or any material designed to disrupt, damage or limit the functionality of telecommunications equipment, including any software viruses or any other computer code, files or programs, you agree not to send, email or send or otherwise transmit. We may cancel or restrict your use of our service if you violate these Terms of Use or use the service illegally or fraudulently.
4.7. The sound quality of Fabula content may vary from device to device and may be affected by various factors, such as your location, the speed of your Internet connection and the bandwidth it offers. It is recommended to have a download speed of at least 5.0 Mbps per content to listen to content. All Internet access charges are your responsibility. Contact your Internet provider for information about current charges for Internet data usage. The time it takes to start listening to Fabula content; Your location will vary based on several factors, including current bandwidth, the content you choose, and your Fabula-enabled device settings.
4.8. Fabula software was developed by or for Fabula and is designed so that Fabula content can be accessed through Fabula-compatible devices. This software may vary depending on the device and usage environment; features and characteristics may vary from device to device. You acknowledge that the use of third-party software subject to third-party licenses may be necessary to use the Service. You agree that you may automatically receive updated versions of Fabula and related third-party software.
Passwords and account access. The member who created the Fabula account and paid through the chosen Payment Method for the service fee ("Account Holder") has access to and control over the Fabula account and Fabula-enabled devices used to access our service, and is responsible for all transactions made through the Fabula account. To maintain control of the account and prevent others from accessing the account (in such case, the account's playback history will be known). It is your responsibility to ensure the accuracy of the information you provide to us regarding your account and to update the information as necessary. To protect you, Fabula or our partners from identity theft or other fraudulent activity, we may cancel or suspend your account.
Warranties and limitation of liability. The Fabula service is provided "as is" and without commitment or condition. Specifically, our service may not be uninterrupted or error-free. You waive all special, indirect or consequential damages to us. These terms do not limit any warranty that cannot be waived or consumer protection rights you may have under the laws of your country of residence.
Waiver of class action lawsuits. IF APPLICABLE UNDER APPLICABLE LAW, Fabula AND YOU MAY ONLY MAKE CLAIMS AGAINST EACH OTHER AND YOUR COLLECTIVE OR DELEGATED LIABILITY ARE CITED. Furthermore, where applicable under relevant laws, unless Fabula and you agree otherwise, the court cannot combine the request of more than one person with your request and cannot judge any class action in this regard.
Other Provisions
8.1. Applicable law. These Terms of Use are subject to Turkish laws and may also be interpreted within the scope of Turkish laws.

8.4. Sustainability. If any provision or provisions of these Terms of Use are declared invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will remain in full force and effect.
8.5. Terms of use, changes and transfer. Fabula may change these Terms of Use from time to time. We will notify you at least 15 days before such changes take effect for you. We may assign or transfer our agreement with you, including our related rights and obligations, to another party at any time, and you agree to cooperate with us in connection with such transfer or assignment.
8.6. Electronic communications. Information about your account (payment permissions, invoices, password or payment method changes, confirmation messages, notifications, etc.) will only be transmitted to you in electronic format. E.g; through emails sent to your email address during the membership process.
